Terms

“Club (Club) Fees” means the amounts that are due and payable by a Club or organizer of championships and events in exchange of use of the ProRegatta platform. ProRegatta determines the different amount paid (different credits levels) in its published price list. The Club may in his or her sole discretion decide which credit level will purchase.

“Sailors (Users) Fees” means the fee that ProRegatta may charge for the for the use of its online platform and Pro App, will be published in the price list. The Fees, when they exist, will be displayed to the Sailor when the Sailor starts using the ProRegatta platform and App. As of August 12, 2019, there is no charge for the sailor for the use of the platform.

“Tracking (Tracking) Fees” means the fee that ProRegatta charges a Club for the use of tracking provided by the ProRegatta App, in its online platform during championships: The value of each tracking will be displayed on ProRegatta price list.

“Service Fees” means collectively the Club Fees, Tracking Fees and Sailors Fees.

“Total Fees” means collectively the Club Fees, Tracking Fees and Sailors Fees (plus any Taxes in respect of Guest Fees, such as VAT in Europe).

Service Fees

In consideration for the use of ProRegatta online SaaS platform and App, ProRegatta charges the Service Fees. Where applicable, Taxes (such as VAT in Europe) may also be charged in respect of the Club Fees, Tracking Fees and Sailors Fees. ProRegatta deducts credits from the Club as per use according to the price list

Except as otherwise provided herein, Service Fees are non-refundable.

Payments

ProRegatta Payments will be collected via the purchase of credit packages according to the price list. Some methods involve the use of third-party payment processors, who may impose their own additional charges for the use of their services on the Club, including by deducting their charges from the payout amount.

Cancelations and Refunds

If, as a Club, you cancel your purchased credits before the use of any of the credit package within 30 days, you will receive the total amount minus any charges the Payments provider might charge. ProRegatta will cancel any credits available to the club and/or refund any nominal amounts charged to your credit card in connection with the requested booking within a commercially reasonable time.

What are the service charges for the Providers?

ProRegatta does not charge the purchasing of credits packages on our online platform. ProRegatta is not responsible for any fees the Payment providers might apply to the transaction to the club.

Both, Clubs’ rates, Tracking Rates and Sailors’ rate are calculated according to the List price published on the ProRegatta site. Our system can only handle with integers and will round the fee for a dollar value.

Depending on the laws of the jurisdiction involved, VAT on service charges may be included as an additional amount above the rate of 10% service. The service charge presented to you on our site that include VAT, where applicable.

What are the service charges for the Sailors?

ProRegatta may charge a fee to the sailors for the use of the tracking. If and when any fees will start being implemented will be posted on the list price of the site. Some methods involve the use of third-party payment processors, who may impose their own additional charges for the use of their services on the Sailor, including by deducting their charges from the payout amount.
